What is the Parkside at Perry Home Owners Association?

A Not-For-Profit Corporation, chartered by the State of Texas.

How are the Officers of the Association elected and when do they meet?

Once each year a nominating committee meets to recommend candidates for open positions on the Board of Directors. The election then takes place during the annual Home Owners meeting in October. Only lot owners of record in the community are eligible to run for the Board. The Board meets once a month. [See News & Events page for specific meeting dates.] The meetings are open to all residents, but a part of the meeting, called the Executive Session is closed to all but Board members, because of the sensitive nature of the information that may be discussed.

Can a person renting or leasing a house in the subdivision attend the annual meeting and vote for the candidates?

Yes they can attend, but voting is restricted to lot (home) owners only. If the tenant carries a proxy from the lot owner to the meeting then they may cast a vote on their behalf.

Why do we need Deed Restrictions?

We live in an unincorporated area, so there are no city building codes or ordnances. The Deed Restrictions are a means of regulating the community so that it remains an attractive place to live, maintains our property values, and gives us a code of behavior to follow so that we may all live to together.

Are the Deed Restrictions enforceable and who is responsible for enforcing them?

Each homeowner, at closing, signed a document that said they would abide by the Deed Restrictions and they are enforceable in a court of law, at the homeowner’s expense for any legal fees that may be incurred in the enforcement process. The Board of Directors is responsible for enforcement of the Deed Restrictions and have hired a management company and an attorney to be the actual enforcers.

What happens if we want to make a change to the Deed Restrictions?

Deed Restriction changes must be approved by a two-thirds vote of the owners of all lots in the community.

I am leasing/renting my house, do I have to abide by the Deed Restrictions and where do I get a copy?

Any violations of the Deed Restrictions by a tenant will be enforced by the Association through the owner of the property. It will be up to the owner to correct the situation with their tenants.  Repeated violations by a tenant and the Association will insist upon eviction. The homeowner or the real estate company handling the rental is responsible for providing a copy of the Deed Restrictions. For a copy of the Deed Restrictions visit the Deed Restrictions page.

If I see or suspect, illegal activity, or a Deed Restriction violation, who do I call, the Directors of the Association, the Management Company or the Police?

The Constable or Sheriff for law violations. Report all suspected Deed Restriction violations to AMI, our management company (see Contacts)

How are the annual homeowner fees calculated?

Each October, the Board of Directors meets in public session to consider and approve a budget for the coming fiscal year starting in January. The total amount of the budget is then divided by the number of homes in the community (168) to determine how much the annual maintenance fees will be per lot. Included in the budget is a certain percentage set aside in an interest bearing savings account for a reserve fund to repair or replace high value items of common property such as streets, gates, pumps, etc. In case of a fiscal emergency, the Board may vote additional assessments during the year. However the total of all annual assessments may not exceed a ten percent increase without the approval of two-thirds of all the lot owners.

I don’t like the way my lawn is being mowed by the Association, can I mow my own lawn, or hire another company to do it?

The price for the contract with the landscape company is based on all the homes in the community being mowed at one time. Exceptions are an added expense. Additional mowing by the homeowner will not result in a reduction of that person’s annual maintenance fee and the homeowner could be charged extra if they insist on making an exception.

Who is responsible for planting, fertilizing, and watering the flowerbeds and lawns on my property?

The homeowner. Lack of maintenance of these areas is a violation of the Deed Restrictions and the Association has the right to enter the property and correct the situation at the homeowner’s expense.

May more than one family live in a house here and share the expenses?

No, the Deed Restrictions limit the occupancy of a house to one family with the total occupants not to exceed the number of bedrooms multiplied by two.

Why do we have gates?

All the property, including the streets, within the fences and the gates is private property. The gates discourage trespassing and unnecessary traffic through our subdivision.

I just moved here, how do I obtain the gate codes for entry and where do I purchase the remote control device that everyone seems to have?

My gate remote control is not working anymore, what can I do?

First try to replace the lithium batteries. They can be purchased at Interstate Batteries (1960 @ Jones Road). If the remote is still not working, you can take it to Stewart Door Company (see the Contacts page) and they will reprogram it for you. Or, you can find a neighbor with a two-button remote that opens the gate in your Parkside section. Take the visor clips off the backs of both units. Push down both buttons on the non-working remote until the small yellow indicator light illuminates on the back. While still holding in the two buttons on the non-working remote, place the remotes back to back with FCC labels touching and push and hold the gate button on the working remote for 15 seconds. Release all buttons and go to the gate to check to see if your gate remote is now working.

Can I give my gate code to all my friends, relatives, and the pizza delivery person?

The more outsiders that know the gate codes, the less secure our property becomes, as there is no way of controlling to whom they may pass the code.  There is a phone on the gate that is to be used for letting visitors or delivery people into the property. Once inside the gate, the homeowner is responsible for any damage or disturbance a visitor might cause.

Why is there such limited parking for residents and guests?

When Parkside at Perry was originally built, the developer maximized the amount of land available to build houses, and their intent was that all residents park in their driveways or garages.   This makes for a much nicer appearance of the neighborhood, and more importantly, it allows for passage of emergency vehicles. 

However, there are times when guests stay overnight and more parking space is temporarily needed.  Our parking rules were established by the developer from the beginning phase of our community, and these rules are backed up by our Deed Restrictions.  These rules are enforced by having violators towed.   We do not want our residents to have to deal with the hassle and expense of being towed, so the Board adopted Guest Parking Permits as a privilege to residents, yet this privilege can be revoked due to your HOA account not being current.

How can I obtain a parking pass for an overnight visitor so that they may park on Farrell Drive and not be towed?

Can a resident park on Farrell Drive overnight?

Only in cases of emergency where the vehicle may be temporarily inoperative. See Contacts page for names and contact information to obtain a visitor parking pass until the vehicle can be towed away for repair. The vehicle must be removed the next business day or will be towed at the owner’s expense.

My vehicle was parked illegally and has been towed away, who do I call?

Call the towing company directly—see the Contacts page for the number. The number is also available on the No Parking signs at each entrance gate. Once your vehicle is in the hands of the towing company, do not call a Board member or the Management Company. Your vehicle can only be released by paying the charges that have been incurred for towing and storage. The towing company does not accept checks or credit cards, so bring cash to the storage yard. The best solution is not to violate the parking rules in the first place.
